Terms of Service

These Terms of Service ("Terms") govern your use of Nolxy, an API Gateway platform (the "Service"), operated by Davide Ricca, Via Antonio Romano 35, 97019 Scoglitti (RG), Sicily, Italy.

By creating an account or using the Service, you agree to be bound by these Terms in their entirety.

1. Experimental Beta Phase

NOTICE: Nolxy is currently in a free experimental beta phase.

By using the Service, you expressly acknowledge and agree that:

  • The Service is provided "as is" (AS IS) without any warranty of availability, continuity, or fitness for a particular purpose.
  • The Service is not suitable for use in critical production environments or mission-critical applications.
  • Interruptions, data loss, or malfunctions may occur without prior notice.
  • The Service may be modified, suspended, or discontinued at any time.
  • No Service Level Agreement (SLA) is provided during the beta phase.
  • Collected data may be used in aggregated and anonymized form to improve the product.
  • The persistence of logs and analytical data is not guaranteed. Log retention periods may change without prior notice.
  • The Service is free during the beta phase. No payments are required.

It is recommended to use Nolxy exclusively in test and development environments.

2. Acceptance

By accessing or using the Service, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

3. Description of the Service

Nolxy is an API Gateway that proxies, authenticates, rate-limits, caches, and logs HTTP requests on behalf of your backend services. During the beta phase, only the free plan with usage limits is available.

4. Accounts

  • Registration is via OAuth (GitHub or GitLab). No passwords are stored.
  • You are responsible for the security of your account and your API keys.
  • You must provide accurate information when registering.
  • You are responsible for all activity under your account.
  • If you suspect unauthorized access, notify us immediately at support@nolxy.com.

5. Acceptable Use

You agree not to use the Service to:

  • Proxy illegal content or services
  • Distribute malware, phishing, or spam
  • Attempt to bypass rate limits, quotas, or security controls
  • Perform DDoS attacks or use the Service as an amplification vector
  • Reverse-engineer, scrape, or exploit the Service beyond its intended use
  • Impersonate another person or entity

We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice.

5.1 Prohibited Proxy Usage

Nolxy is designed to proxy traffic to your own backend APIs or to third-party APIs that you are authorized to access. The following uses of the proxy are strictly prohibited:

  • Web scraping or crawling: Using Nolxy to scrape, crawl, or harvest data from websites or services without explicit authorization from the target service owner.
  • Traffic amplification: Using Nolxy to amplify traffic volume against a target, including DDoS attacks, stress testing of third-party services, or bandwidth exhaustion.
  • Identity concealment: Using Nolxy to hide your identity or origin IP address for the purpose of circumventing bans, blocks, geoblocking, or access restrictions imposed by target services.
  • Terms of Service violation: Proxying requests to any service in a manner that violates that service's terms of use, acceptable use policy, or robots.txt directives.
  • Unauthorized access: Using Nolxy to access APIs, endpoints, or resources for which you do not have valid authorization or credentials.

All outgoing proxy requests include a Nolxy-Gateway User-Agent identifier, allowing target services to identify and report abusive traffic. For abuse reports, see our Abuse Policy.

6. API Keys

API keys are credentials that authenticate requests to your gateway. You are responsible for keeping them secure. Lost keys cannot be recovered and must be regenerated. Compromised keys should be revoked immediately from the dashboard.

7. Service Availability

We strive to maintain high availability but do not guarantee 100% uptime. The Service is provided "as is" and "as available". No SLA is offered during the beta phase.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy.

Processing role: for API logs that transit through the gateway, Nolxy acts as a Data Processor on behalf of the user (Data Controller). For account data, Nolxy is the Data Controller.

9. Intellectual Property

The Service, including its code, design, documentation, and branding, is the property of Nolxy / Davide Ricca. You retain full ownership of your APIs, your data, and your configurations. We claim no rights over traffic that transits through the gateway.

10. Limitation of Liability

To the maximum extent permitted by law, Nolxy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

As this is a free service in beta phase, Nolxy's total aggregate liability for any claim related to the Service is limited to zero euros (€0).

11. Indemnification

You agree to indemnify and hold harmless Nolxy and its operator from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Suspension and Termination

You may delete your account at any time from the dashboard settings. We may suspend or terminate your access if you violate these Terms, with or without prior notice. Upon termination, your data will be deleted in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice within the Service. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Court of Ragusa, Italy, except where mandatory consumer protection laws provide otherwise.

15. Specific Approval of Onerous Clauses (Art. 1341 and 1342 Italian Civil Code)

Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the user declares to have carefully read and specifically approves the following clauses of these Terms of Service:
